These Terms of Service ("Terms") are a binding agreement between you and MyPerson LLC ("Find Your Person," "we," "us," or "our") governing your access to and use of the Find Your Person app, website, and related services (collectively, the "Service").
By creating an account or using the Service, you agree to these Terms.
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that:
Find Your Person is a relationship-oriented platform that allows users to create profiles, provide preferences and profile content, generate AI-based avatars, search and view other profiles, use messaging features where available, and access free or paid features.
We may modify, suspend, limit, or discontinue any part of the Service at any time.
You must provide accurate account information and maintain the security of your account credentials. You are responsible for activity that occurs through your account.
We may require email verification and may suspend or remove accounts that are false, deceptive, unsafe, inactive, or otherwise in violation of our rules.
Certain messaging or communication features may be available only to users with a paid subscription or other qualifying access level. For example, the ability to initiate a first message may be limited to premium subscribers or other categories of users designated by us.
We may change feature availability, eligibility, functionality, or restrictions at any time.
Certain features may be offered on a monthly, annual, or other recurring subscription basis, as described at the time of purchase.
If you purchase a subscription:
We may change pricing, features, or plan structure prospectively.
In addition to these Terms, we may present a short-form purchase summary in the app at the time of purchase. That summary may describe the premium feature being purchased, the applicable billing cycle, whether the subscription renews automatically until canceled, how to cancel, and the fact that billing, cancellation, and certain refund mechanics may be governed by the applicable app store or payment provider. In the event of a conflict between a purchase screen required by applicable law or platform rules and these Terms, the more specific purchase disclosure will control to the extent of that conflict.
You may submit content, including profile information, prompts, preferences, selfies, avatars, messages, reports, and other materials (collectively, "User Content").
You retain whatever ownership rights you may have in your User Content, but you grant Find Your Person a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify, adapt, process, display, transmit, review, moderate, and otherwise use your User Content as necessary to operate, improve, secure, promote, and support the Service.
This license includes use of content for moderation, trust and safety review, customer support, troubleshooting, and avatar generation.
You represent and warrant that you have all rights necessary to provide your User Content and to grant this license.
The Service may generate avatars or similar outputs based on user-submitted images and prompts. These outputs are AI-generated interpretations.
You acknowledge and agree that avatars:
Find Your Person does not guarantee the realism, likeness, accuracy, or consistency of any avatar.
You may not use the Service to:
We reserve the right to restrict, review, remove, or act upon content or conduct that is misleading, unsafe, exploitative, spammy, infringing, abusive, inconsistent with the intended purpose of the Service, or otherwise objectionable in our discretion.
We may use automated tools, human review, user reports, and other methods to detect, investigate, review, and address possible violations of these Terms, our Community Guidelines, or applicable law.
We may warn, limit, remove, suspend, or terminate accounts, content, communications, or access at our discretion.
Find Your Person does not perform criminal background checks on users unless expressly stated otherwise. We do not guarantee the identity, intentions, conduct, truthfulness, or background of any user.
Users are solely responsible for exercising caution and good judgment when interacting with others, whether online or offline. If you choose to meet someone in person, you do so at your own risk.
Find Your Person is a platform. We do not guarantee:
User profiles display a first name rather than a separate username. You may not use a false, misleading, offensive, infringing, or otherwise improper name or profile presentation.
We may edit, reject, remove, or require changes to names, profiles, avatars, or content that violate our rules or create risk for users or the Service.
You may stop using the Service and delete your account at any time through available in-app features.
We may suspend or terminate your access at any time if we believe you have violated these Terms, created risk, harmed other users, exposed us to liability, or acted inconsistently with the intended use of the Service.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYPERSON LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY U.S. DOLLARS (US $50).
To the extent permitted by law, you agree to indemnify, defend, and hold harmless MyPerson LLC and its affiliates, members, officers, employees, contractors, and service providers from and against claims, liabilities, damages, losses, and expenses arising out of or related to your User Content, your use of the Service, or your violation of these Terms or applicable law.
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles, except to the extent federal law requires otherwise.
Please read this section carefully. It affects how disputes between you and Find Your Person are resolved.
To the maximum extent permitted by law, you and MyPerson LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved on an individual basis through final and binding arbitration rather than in court, except that either party may bring an individual claim in small claims court if it qualifies.
You and MyPerson LLC also agree that claims may be brought only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, representative, or similar proceeding.
Before starting arbitration, the party seeking relief must first send the other a written notice describing the dispute and the requested relief, and the parties will attempt in good faith to resolve the matter informally for at least 30 days.
If the matter is not resolved informally, the arbitration will be administered by the American Arbitration Association under its applicable consumer rules, unless the parties agree otherwise. The arbitrator may award any relief that would be available in court on an individual claim.
If a court decides that this arbitration section cannot be enforced as to a particular claim or request for relief, then that claim or request for relief will be resolved in court, and the remaining portions of this section will still apply.
If this arbitration section is found unenforceable in full, any dispute shall be brought exclusively in the state or federal courts located in Texas, and you consent to their jurisdiction and venue.
If you believe that content available through the Service infringes your copyright, you may send a written notice to support@findyourperson.app with the subject line "Copyright Notice."
Your notice should include:
We may remove or disable access to allegedly infringing material and may terminate repeat infringers where appropriate.
We may modify these Terms from time to time. If we make material changes, we may provide notice through the Service, by email, or by other reasonable means. Your continued use of the Service after the updated Terms become effective constitutes your acceptance of the revised Terms.
